Business Innovation Stream 188A

This provisional visa is for people with business skills. It lets you operate a new or existing business in Australia.

This provisional visa focus on evaluating company's turnover; the requirement of the initial amount of investment is not demanding, and the investment methods are varied. This provisional visa is, among other similar type of visa, the least demanding regarding personal assets. This provisional visa is aimed to attract SMEs whom has innovative capability or successful experience to practice business venture in Australia

Visa 188A uses the points test system to evaluate which not only consider net personal assets and business turnovers, but also the age of the applicant, education level, English level and etc. Applicant must first meet the standard, score over 65 on the points test, submit EOI, granted with state nomination then granted with invitation to proceed the application.

Benefit of this Visa

  1. The required assets are not demanding. The minimum amount required for visa 188A is only AUD 1.25 million.
  2. The required investment is not demanding, and the invested business type is flexible.

Requirements:

  1. Under 55 years of age or being granted with exemption from State/Territory government
  2. Net business & personal asset of 800,000 AUD available to transfer to Australia
  3. Whether you have 1 or 2 businesses, you must own at least: 51%, of the total value of the business if the business has a turnover of less than AUD400,000 per year; 30%, of the total value of the business if the business has a turnover of AUD400,000 or more per year, or; 10%, of the total value of the business if the business is operated by a publicly listed company
  4. Score at least 65 on the points test
  5. Have a successful business career
  6. You must have a genuine desire to continuously own and manage a business in Australia.
  7. The main applicant must not spend more than 50% of the time in this business providing professional, technical or business service.
  8. All applicants aged 18 or over at the time of application must either have at least functional English or you will be asked to pay the second instalment of the visa application charge.
  9. If you have not yet met the requirement of visa 888a (permanent visa) before your visa 188a expire, you can apply a two years 188a extension visa

Investor stream 188B

Provisional visa 188B which is a 5-year temporary visa is designed for those who want to carry out business and investment activity in Australia. While whether you have held shares in a business is not essential, this visa focus on the main applicant’s investment ability, the main applicant must have outstanding investment experiences. This provisional visa is more suitable for professional investors. Applicants do not need a high school diploma or English score to apply for this provisional visa. Applicants also do not need to be employed in or hold shares in any business as long as applicants have successful investment experience and are willing to invest at least AUD 2.5 million in a designated area.

Applicants who have maintained their at least AUD 2.5 million investment after 3 years of being granted this visa are eligible to apply for 888B permanent visa.

Requirements:

  1. Be under 55 or unless the State or Territory government agency has determined your investment will be of exceptional economic benefit.
  2. Score at least 65 on the points test
  3. Proof that applicants have outstanding investment and management abilities
  4. Have at least 3 years' experience managing one or more qualifying businesses or eligible investments
  5. Applicants need to satisfy one of the following:
    • For at least 1 of the 5 fiscal years immediately before you are invited to apply, have directly managed a qualifying business in which you, your partner or you and your partner combined had at least 10% ownership interest
    • For at least 1 of the 5 fiscal years immediately before you are invited to apply, have directly managed a a eligible investment of at least AUD 2.5 million owned by you, your partner, or you and your partner combined,
  6. For the 2 fiscal years immediately before we invite you to apply, you, your partner, or you and your partner together, have a business and personal assets with a net value of at least AUD 2.5 million
  7. If you were invited to apply for this visa, you must make a complying significant investment of at least AUD 2.5 million, which includes:
    • 20% (AUD500,000) in venture capital or growth private equity fund
    • 30% (AUD70,000) in emerging companies fund
    • 50% (AUD120,000) of balancing investment in managed funds or public companies

Significant Investor Stream 188C

The provisional visa 188C, also commonly known as the 5 million dollars investor stream, is a 5 years visa designed for applicants who are willing to invest AUD 5 million. Applicants who have maintained their AUD 5 million investment after 3 years of being granted this visa are eligible to apply for 888C permanent visa.

Requirements:

  1. You must be nominated by an Australian State or Territory government agency or Austrade before being invited to apply for this visa.
  2. Net personal and business asset of AUD 5 million, and make complying significant investment into the following:
    • 20% (AUD 1 million) into venture capital & growth private equity
    • 30% (AUD 1.5 million) into emerging companies funds
    • 50% (AUD 2.5 million) of balancing investment in managed funds or public companies
  3. All applicants aged 18 or over at the time of application must either have at least functional English or you will be asked to pay the second instalment of the visa application charge.
  4. If you have not yet met the requirement of visa 888C (permanent visa) before your visa 188C expire, you can apply a two years 188C extension visa

Entrepreneur Stream 188E

Visa 188E is a brand new visa type that is introduced at September 10th 2016. Similar to all other 188 visa types, this is a provisional visa that let you stay for 5 years.

This provisional visa require applicants to have some level of English skill, applicants need to score at least 6 in each of the 4 test components in IELTS, thus, is more suitable for students and others who have innovated business ideas. After meeting the requirements, applicants can apply 888E permanent visa.

Visa 188E is designed to aim at individuals who have innovated business ideas. Australian government wants to use this visa to attract the best, the brightest, the skilled, talented entrepreneurial people.

Benefit of this Visa

No business experience required. Applicants only need to meet age, English and entrepreneur requirement to be able to apply. This visa does not require any personal assets, it does not require any work experience and it does not require education level.

Requirements:

  1. Be under 55 or unless the State or Territory government agency has determined your investment will be of exceptional economic benefit.
  2. Be nominated by a State or Territory government agency
  3. Meet Competent English requirement
  4. You must be undertaking, or proposing to undertake, a complying entrepreneur activity in Australia. You must have a genuine intention to continue this activity.
    • A complying entrepreneur activity must relate to an innovative idea that will lead to the commercialisation of a product or service in Australia, or the development of an enterprise or business in Australia. This activity must not relate to residential real estate, labour hire or purchase of an existing enterprise or a franchise in Australia
  5. Have enough perosnal assets to settle down in Australia
  6. Not have a history of involvement in unacceptable activities
  7. Have no debt to the Australian government

888 Permanent Visa Requirements:

888A
  1. Be nominated by a State or Territory government agency
  2. For the 24 months immediately before you apply, you must own at least:
    • 51% of the total value of a business with a turnover of less than AUD400,000 per year
    • 30% of the total value of a business with a turnover of AUD400,000 or more per year
    • 10% of the total value of a business that is operated by a publicly listed company
  3. Have an annual turnover of at least AUD300,000 in the 12 months immediately before the application
  4. For the 12 months immediately before you apply, satisfy 2 out of the 3 following requirements:
    • Net value of business asset of at least 200,000 AUD
    • Net value of business & personal asset of at least 600,000 AUD
    • Hire at least 2 full-time eligible employees in your main business
  5. The main applicant have been physically present in Australia for at least 1 year in the 3 years
888B
  1. Be nominated by a State or Territory government agency
  2. Main applicant stays in Australia for at least 2 years in the 4 years immediately before the application was made
  3. Maintain the designated investment for 4 years
888C
  1. Be nominated by a State or Territory government agency
  2. Maintian the AUD 5 million investment during the three years of visa 188C
  3. Main applicant stays in Australia for at least 180 days in the 4 years’ period or spouse of applicant to stay 720 days in the 4 years’ period
888E
  1. Be nominated by a State or Territory government agency
  2. Held 188E for 4 years and reside in Australia for at least 2 years
  3. Have a successful record of entrepreneurial activities
    • employing Australians, permanent residents or other eligible persons
    • receiving ongoing funding or investment in your entrepreneur activity
    • annual turnover
    • entering into a partnership with a university
